It was the longest meeting we have had in my memory, and it was also enormously fruitful for clarifying some policy expectations. 聽</p> <p>Significant time was spent discussing the testimony we offered to the Sunset Commission on November 14th. More information will be provided over the next couple of months to our stakeholders on specific topics raised by the Sunset review process, but for now, let me say that we fully acknowledge the strong emphasis the Sunset Commission has placed on ensuring that our Agency鈥檚 customer service functions reach new levels of effectiveness and efficiency. While we have always been both accountable and transparent about our efforts to address our shortcomings, resolve any issues and improve our results, we are committed to work with much greater urgency toward setting and achieving new performance goals.聽 Several recent examples of improvements demonstrate this commitment.聽<img alt="" src="/sites/default/files/avis%20from%20KW%203%20%28002%29%20-%20web.jpg" style="border-width: 1px; border-style: solid; margin: 1px; float: right; width: 200px; height: 200px;" /></p> <p>Once determined each was technically feasible for our contact center鈥檚 VOIP phone system, it took just two months to implement the call-tree feature and another two months to implement the call-back feature. Both features made significant reductions in our average hold times and abandonment rates.聽 We are working simultaneously on additional improvements and have produced results in short order. One accomplishment that we are very proud of is the ability for a license holder to print a certified license history directly from the license records displayed on the trec.texas.gov website. 聽Obtaining a certified license history previously required submission of a form and a fee, and took about ten days to complete. That customer service is now available immediately at the click of a button and at no cost! 聽聽聽聽聽聽聽聽聽聽聽聽聽</p> <p>In addition to the focus we gave to Sunset matters, we also accomplished the more routine business of the Commission, including advancing important policy goals connected to both education and broker responsibility. We appointed seven new members to the Education Standards Advisory Committee and look forward to their contributions. We adopted rules providing additional clarity and details for brokers in better managing potential risks and enhancing performance of the broker鈥檚 business. 聽聽</p> <p>In the area of broker responsibilities, we clarified that every 鈥渢eam lead鈥� must be a delegated supervisor not later than 3 months after assuming those responsibilities. In addition to the formal response the agency filed at their website, we look forward to sharing more positive details about our progress as we continue to improve and learn from this important oversight process.</p> <p>On November 15<sup>th</sup>, the Commission will meet for its regular quarterly meeting, but in a new location at the State Capitol Extension. See our website for the location map, agenda and materials. 聽On that same date, the Board will hold a workshop, followed by its regular quarterly meeting on Friday, November 16<sup>th</sup> at our normal location in the Stephen F Austin Building. Materials will be on the Board website shortly.</p> <p>Because 2019 is a legislative session year, and we are undergoing sunset review, we know there will be at least one bill directly affecting our agency. We trust it will allow us more opportunities to continue our mission of enhancing the high quality of real estate services available to Texas consumers. I am happy to report that over the last several months, due to the implementation of technological improvements, additional staff, and the hard work of existing staff, there has been a marked improvement in the overall performance of both.</p> <p>On the call center front, the Agency instituted a Call Routing System, or call tree, in June and a Courtesy Callback feature at the end of August. The call tree gives a person calling the agency the option of pressing a number to direct a call to a fully qualified person based the type of information needed. The Courtesy Callback feature allows a caller the option to leave their phone number with us without losing their place in the queue. Instead of waiting on hold for their call to be answered, once it is their turn to receive assistance, the system will automatically call them back and connect them with a live person. Both of these features have helped reduce the wait times and increase the number of persons the call center staff is able to assist on a daily basis.</p> <p>For example, for the month of October, a total of 22,445 calls came into the call center. This was a 13% increase in the number of calls received by the agency in September. Of these calls, staff engaged with 18,686 callers, or 84% of the total calls received. While this was the same percentage of calls handled by staff the previous month, staff assisted an additional 2,414 individual callers, an increase of 15% from the previous month. 6,695 calls were returned through the 鈥渃ourtesy call back鈥� feature, or 36% of all calls handled in October. 聽Since the Courtesy Call Back feature was implemented at the end of August, over 14,000 callers have used it.聽</p> <p>The staff has also made progress on the top IT-related projects that we believe have the greatest effect on the frontline operations of the agency. For example, anyone who currently wants a Certificate of License History for a license holder must submit a form and pay to have the history researched and completed. This process is time-consuming for both staff and the person requesting the certificate.聽 Over the last month, extensive work has been done to automate that process. Once automated, a PDF of a license history will be generated about a license holder at no cost to the requestor via the agency website. Automation of this process accomplishes two things. First, it provides this information to the requestor immediately for free, without having to wait for agency staff to research and process the request. Secondly, it automates a process that often requires one staff person up to 20 hours per week to complete. That staff will be able to spend more time聽processing applications and renewals. We hope to have this process automated for real estate license holders by mid-November. It will be implemented for appraiser license holders at a later date.</p> <p>Staff is also working on an 鈥渁pplication status tracker鈥� that will allow an applicant to go on the website and track the status of his or her particular application. The tracker will provide an applicant with information via the website that the applicant would otherwise have to call the agency to get. We hope to have the application tracker operational by the end of the year. 聽The tracker will initially be implemented for new sales applications only, our highest demand item. 聽Please note that this is the first step in developing a more robust 鈥渓icense holder portal鈥� through which new applicants and existing license holders can manage their accounts and licenses with the agency. Other more complex license types will be added as additional progress is made on this project. 聽聽</p> <p>Staff has also made progress regarding an online process uploading application and education documents through our online services instead of faxing or emailing them to the Agency. If all goes as planned, the Agency is on track to implement that service sometime in January 2019. The reliability of this communication has been our major challenge in 2018.聽 The agency upgraded its phone system in June 2017 and began exploring a new integrated software solution for better management of our contact center.聽 After several incremental steps to remedy the situation did not achieve meaningful improvements, and our requests for software solutions proved increasingly complex, in April we added 25% more staff in our contact center to ensure calls and emails are responded to more quickly, and 10% more staff to our license application processing team.聽 In June we implemented new user-selected call routing options and in late August we added a new automated call-back feature. 聽聽</p> <p>As of July, we announced Tony Slagle as the new Deputy Executive Director with a major duty focus on the two agency divisions that provide the most immediate front-line customer service. In August, the Agency dedicated an additional $1.3 Million to greatly accelerate some previously identified technology projects that will have the impact of improving our customer service.聽 The combined effect of all these enhancements has been to greatly increase the number of calls and emails the agency staff can handle timely, and a significant reduction in average hold times and response intervals.聽</p> <p>While these are solid improvements, we have much more to do to restore confidence in our ability to respond effectively to new developments in realty market business practices, rapidly accelerating technology opportunities and disruptions, and continued growth in our license holder population. The Executive Director was delayed for about an hour arriving for the meeting due to air travel delays on Sunday that resulted in a cross-country reroute and pushed his final flight to Monday morning.聽 So our very able Deputy Executive Director and General Counsel Kerri Lewis delivered the Executive Director鈥檚 report.聽聽聽聽<img alt="" src="/sites/default/files/avis%20from%20KW%203%20%28002%29%20-%20web.jpg" style="float: right; width: 200px; height: 181px;" /></p> <p>Our agency has been extraordinarily busy since we last met in February. The Executive Director sent an open letter to our stakeholders in April outlining the multiple steps that are being taken to address the lapses in our customer service standards. After several incremental fixes did not produce the required improvements, more extensive measures are now being implemented. Thanks to our staff for their exceptional commitment to be retrained, work overtime, add more staff, find process improvements and implement new technology to address every reasonable alternative for making improvements. We will continue to explore and implement every step that we assess will make a positive difference. We are highly encouraged that this multi-dimensional approach will more rapidly produce many reliable improvements.聽 We will not rest until we restore the levels of service we hold ourselves accountable to.</p> <p>Over the last three months, all of the Commission鈥檚 advisory committees and working groups met to advance work in their assigned areas of responsibility and we heard reports from each of them.聽 Our internal auditors and the State Auditor鈥檚 office have completed their work on some of our personnel-related policies and their findings were presented as well.聽 After considering guidance from the Governor鈥檚 office and other state leadership, we accomplished the most extensive strategic planning listening tour in agency history in March and staff compiled the draft plan for our consideration. Based on a request that staff integrates some supplementary data into the draft, the Commission voted to hold another meeting on May 30 to review and approve the final report. 聽At the same time, we received a presentation on the first draft of the Fiscal Year 2019 budget. The second draft will follow in July.</p> <p>On April 2<sup>nd</sup> we held our 2<sup>nd</sup> Annual Residential Realty Issues Summit focused on the effects of disasters on the real estate market. With our event partners from the Real Estate Center at Texas A&amp;M and the Austin Board of REALTORS, panels of market participants and related experts explored relevant aspects of the issue. Many positive comments were received from those in attendance, so we look forward to next year!</p> <p>The information gathering and detailed observation phase of our Sunset Review process kicked off in April with a long and wide-ranging introductory meeting followed by several in-depth interviews with our key operating divisions. Staff from the Sunset Advisory Commission were with us for the meeting to observe in full all that we do to carry out the requirements of our mission. They have also been present for many of the advisory and working group sessions prior to this meeting. Posted on our website is a letter from Ken Levine, the Executive Director of the Sunset Advisory Commission explaining the steps in the Sunset Review and inviting all who wish to be a part of the process. They will welcome your input.</p> <p>Our quadrennial Rule Review process continues, and we adopted some rules to remove barriers or add clarity, including an amendment to the advertising rules that will be effective on May 15<sup>th</sup>.聽聽 We also approved some amendments to the current contract with our exam provider Pearson VUE, and learned about an opportunity to potentially reduce the long-term cost of fingerprint-based background checks.聽 After the meeting adjourned, we saw a short demonstration of the online Names Management Tool we will launch by May 15<sup>th</sup>. 聽Look for a training video and a Facebook Town Hall on the topic next week.</p> <p>We covered a lot of ground during our meeting, and we hope you will take the time to review the video minutes posted on our website or to stop by for one of our future meetings. Several inspectors made the trip to Austin for this meeting.聽 I would like to thank everyone who took time out of their busy schedules to attend and I appreciate your important input. 聽Inspector attendance at these meetings is invaluable because it provides the Committee the opportunity to hear the ideas and concerns of inspectors from all over the state.聽 The Committee is meeting again on Monday, February 26<sup>th</sup> at 10am. Not only will the Committee elect its new officers at that meeting, but also any inspector who attends can receive up to 2 hours of Continuing Education. The SOP Subcommittee will meet at 9AM on that same day prior to the meeting of the full Committee.<img alt="" src="/sites/default/files/Inspector%20Chair%20Headshot%20-%20web.jpg" style="border-width: 1px; border-style: solid; margin: 1px; float: right; width: 200px; height: 252px;" /></p> <p style="margin-left:4.0pt;">The meeting on January 22nd was a busy one. The Committee reviewed the proposed changes to the financial responsibility and insurance rules. The Committee has recommended to the Commission that it take no action at its February meeting on the proposed amendments. This means that if the Commission agrees to take no action, the current insurance requirements will not change. Additionally, the Committee is asking the Commission to remand the issue back to the Committee so that it can properly evaluate all of the issues surrounding the current financial responsibility and insurance requirements and propose a possible legislative change as part of the Sunset process.聽</p> <p style="margin-left:4.0pt;">The Committee also discussed confusion surrounding the inspector鈥檚 relationship to the client, including if and when and inspector is authorized to share data gathered during an inspection. While the current rules do weigh in on what the inspector鈥檚 duties are to the client, the current rules do not define who the inspector鈥檚 client is. The Committee believes clarifying this would befit both inspector and consumer and has asked staff to bring forward a proposed definition to the next Committee meeting.</p> <p style="margin-left:4.0pt;">I want to reiterate what the executive director said in his message last month, the new year will give all of you several opportunities to engage in the policy-making process of the agency. The agency is in the midst of its quadrennial rule review to determine if rules should be continued, amended, or repealed. 聽The inspector rules will be open for review in August of this year. 聽星空体育app下载 will also be traveling the state in March for its statewide strategic planning listening tour where the executive director will gathering input from license holders and other agency stakeholders, as well as updating and discussing future agency initiatives. The major accomplishment for the committee was completing the much-needed revision on the SOP Legal and Ethics continuing education coursework, which became mandatory as of September 1 of last year. This 4-hour course, developed in conjunction with the Texas A&amp;M Real Estate Center provides a consistent framework for providers to use when teaching this very important topic to inspectors.聽 This course was the important first step in the Committee鈥檚 long-term goal to improve inspector education. I know the Committee is dedicated to take even greater strides towards that goal in the upcoming year.</p> <p style="margin-left:4.0pt;">聽As we move forward with this new year, there will be several opportunities for you to be engaged in the policy-making process of the agency. As is required by statute, the Agency has begun its quadrennial rule review. During this process, the agency reviews all of its currently enacted rules to determine if they should be continued, amended, or repealed. 聽The inspector rules are scheduled to be open for review in August of this year and I encourage all inspectors to take an active role in this process.聽 Additionally, in the next couple of months, the agency will begin its statewide strategic planning listening tour. I will be making several stops around the state to update and discuss future agency initiatives, but more importantly, I am traveling around the state to gather input from license holders and other agency stakeholders. This February meeting also provides an opportunity for inspectors to earn up to 2 hours of Inspector Continuing Education (ICE) credit for attending that meeting in person. The first was a modification of a rule regarding when multiple check boxes are used. This rule makes it clear that if an inspector chooses more than one check box, that an explanation must be provided. For instance, if only the Inspected box is checked with no other comments, it could be determined that the area in question was inspected, and no deficiencies were observed. However, if an inspector checks the Deficient and Inspected boxes, or any other combination, then an explanation would be needed. This may seem a bit redundant to us as license holders, but we wanted to ensure that if a consumer sees multiple boxes checked in a report, that there would be a requirement for an explanation. We received public comment on this, both positive and negative, but based on the feedback, it appeared that many were just unclear as to what this means. Most inspectors are doing this already. This rule is simply for clarification.</p> <p>Another item in this rule was to make a change that inspectors will be required to use the standard report form even if only a single system is inspected. When a property that is inspected is subject to a sales transaction, then Standards of Practice must be abided by. Previously, if an inspector was called out to simply inspect a roof, or some other single component to the house, then they would not be required to use the Standard Inspection Report form. When the Inspection Report form was modified and put into use a year ago, there were a lot of modifications that were made to it, including the preamble. That preamble has a lot of information that is directed toward consumer awareness. This rule will ensure that even if a consumer is just getting a single system inspected that they will still be provided this information to help educate them in the inspection process and to know what their rights and responsibilities are.</p> <p>At the recommendation of the TREIC, the Commission聽had changed the timeline on when an inspector is required to provide the inspection report to a client. It was previously set at three days. It was then modified to state that the inspector must submit the report to the client within two days of the date of the inspection, provided that the inspection has been paid for. As a follow up to that rule, there was a clarification made that states that if an inspection is paid for prior to the inspection being completed that the two-day time frame starts from the completion of the inspection or payment for that inspection, whichever is later, unless otherwise agreed to in writing.</p> <p>The current Legal/Ethics/SOP course was the first time that 星空体育app下载 created the actual class, as opposed to providing an outline for education providers to follow. This course renews every two years, on the odd-numbered year. As a result, there is a task force that is currently in the process of updating that course for release on September 1 of this year. Staff, committee members and other subject matter experts have been working hard to get this updated to reflect updated rules, hot topics, and much more.</p> <p>One of the other topics that we are starting to work on is the possibility of reducing the number of license types from three to two. Currently, there are Professional Inspectors, Real Estate Inspectors, and Apprentice Inspectors. The latter two license types are used on a very minimal basis. Reducing the number of license types by one would help streamline a number of processes across the board. This would likely take a legislative change in order to take effect, so the process will be a bit lengthy. The initial thought was to remove the Real Estate Inspector license and keep the Apprentice. Most involved agree that this would likely be the simplest. One of the main areas of discussion though is modifying the pre-licensure requirements for an Apprentice license. Currently, there is no education requirement for someone to obtain an Apprentice license. This may be an unnecessary risk to consumers and the overall education of the inspector. The TREIC will be looking at the possibility of requiring, at the minimum, an 8-hour course that covers the Texas Standards of Practice to help ensure that should someone obtain an Apprentice license that they at least have the base knowledge of what is required from the state regarding what the minimum requirements for an inspection are from a consistent source prior to ever walking into a home to perform an inspection.</p> <p>Officers were chosen during the January meeting, as they are each year. The chair this year will be Lee Warren. The secretary will be Steve Rinehart. Scott Regan was elected as the Vice Chair. However, due to unforeseen circumstances, Scott has since resigned. Scott has been a valued member of the committee, and he will be missed. We look forward to still receiving his input for years to come. This is a very worthy topic of discussion. It also creates an opportunity for me to explain the function of the Texas Real Estate Commission.</p> <p>As a regulatory agency鈥攚e are an executive branch agency鈥攚e answer to the Texas governor through a governing body of nine appointed policymakers. The Texas Legislature decides what types of licenses the Commission regulates. 星空体育app下载 implements the laws passed by the Texas Legislature through the rulemaking process. Additionally, 星空体育app下载 educates, licenses, and disciplines license holders鈥攏o more, and no less.</p> <p>The current regulatory climate in Texas is the same climate that is drawing businesses to Texas. In fact, agencies like ours have been directed to avoid stifling the climate that makes Texas 鈥渙pen for business.鈥� To do so requires the least restrictive means for regulation.</p> <p>We regulate a minimum standard, based on rules and law. We can also teach best practices, but we cannot regulate and discipline based on best practices.</p> <p>As we look for ways to increase broker responsibility and manage professionalism of the industry, we do so with an eye toward opportunities for entry and paths to entrepreneurship.</p> <p>We continue to look for ways to address license holders鈥� concerns around professionalism. There is no one easy fix, so the Commission is considering a multifaceted approach to address these concerns. For example, the Broker Responsibility Working Group has <a href="/article/broker-responsibility-working-group-recommends-response-times-brokers-and-sales-agents">recommended response times for brokers and sales agents and increased oversight of sales agents'聽first-time brokerage activity</a>. The Education Standards Advisory Committee is reviewing ways to incorporate more <a href="/article/education-standards-advisory-committee-recap-broker-agent-relationship-education-future">education on broker responsibility and the broker-agent relationship in course outlines</a>.</p> <p>I know how important professionalism and integrity are in your business, and you have the power to make a difference. We talked about wholesaling, risk reduction/enforcement, education, and provided a 星空体育app下载 update to the Board of Directors. I am grateful for every opportunity to be with our license holder communities, and this was no exception.</p> <p>Throughout the last few months, and even at the most recent Commission meeting, broker supervision has come up as a topic of conversation in various forms, but primarily, it鈥檚 about sales agents who are not properly supervised by their brokers. This concern is often raised by a broker or agent on the other side of a real estate transaction. The Broker Responsibility Working Group (BRWG) and Education Standards Advisory Committee (ESAC) are each looking at aspects of this鈥攑otentially increasing the number of transactions a broker needs to sign off on and identifying qualifying and continuing education opportunities to educate brokers and agents about their responsibilities. As so many new agents join the professional community, equipping them with resources and supporting them is imperative. We will look for avenues to raise the bar from a regulatory and educational standpoint.</p> <p>But I also want all license holders to share in the responsibility to raise the bar.
